Terms & Conditions

These Terms & Conditions (“Terms”) govern your registration for, access to, and
participation in the Beta Hat Research Community (the “Community”), owned and
operated by Beta Hat Industries, LLC (“Beta Hat,” “we,” “us,” or “our”).
By registering for the Community, accessing any portion of the Community, or
participating in any research activity offered through the Community, you agree to these
Terms. If you do not agree, do not register or participate.

These Terms & Conditions (“Terms”) govern your registration for, access to, and participation in the Beta Hat Research Community (the “Community”), owned and operated by Beta Hat Industries, LLC (“Beta Hat,” “we,” “us,” or “our”). By registering for the Community, accessing any portion of the Community, or participating in any research activity offered through the Community, you agree to these Terms. If you do not agree, do not register or participate.

1 -  WHAT THE COMMUNITY IS

The Beta Hat Research Community is a research panel that offers eligible participants opportunities to take part in market research activities that may include surveys, interviews, focus groups, playtests (remote or in-person), online communities, diary studies, and related research engagements (collectively, “Research Activities”). Participation is voluntary. You may decline any invitation and you may stop participating in a Research Activity at any time, although you may not receive an Incentive (defined below) if you do not complete the Research Activity.

2 - ELIGIBILITY

To register for and participate in the Community, you must:

  • Be 18 years of age or older

  • Be a resident of the United States

  • Provide accurate, current, and complete information during registration and participation

  • Maintain only one account per person, unless Beta Hat approves otherwise in writing

COPPA AND AGE RESTRICTION

The Community is intended only for individuals 18 years of age or older.

We do not knowingly collect personal information from children under the age of 13. If you are under 13, you may not register for or participate in the Community.

If we learn or have reason to believe that a Community member is under 13, that individual is ineligible and we will terminate their membership and remove their information from our systems, consistent with applicable law.

We may refuse, suspend, limit, or terminate your access to the Community at any time if we believe you do not meet eligibility requirements or violate these Terms.

3 - REGISTRATION AND PARTICIPATION IDENTITY

When you join the Community, you may be asked to provide information such as your name, email address, phone number, and other eligibility details (“Registration Information”). You agree to provide accurate Registration Information and to keep it up to date.

You may not register more than once, use multiple email addresses or phone numbers to create duplicate registrations, or otherwise attempt to participate under more than one identity.

You may not allow any other person to participate on your behalf or submit responses on your behalf.

If we detect duplicate registrations, misrepresentation, or participation by someone other than the person who registered, we may remove you from the Community, disqualify your participation, and withhold incentives associated with fraudulent activity.

 

4 - RESEARCH INTEGRITY AND QUALITY STANDARDS

Research depends on honest, thoughtful participation. By registering and participating, you agree to provide responses that are:

  • Truthful and based on your real experiences and opinions

  • Provided in your own words

  • Made in good faith, with reasonable effort

  • Prohibited Use of Artificial Intelligence

AI-generated responses are prohibited. If we determine that you used artificial intelligence tools to generate or substantially assist your responses, your responses may be invalidated, you may not be compensated for that Research Activity, and you may be removed from the Community.

Additional Prohibited Conduct

You agree that you will not:

  • Provide false, misleading, or intentionally inconsistent information to qualify for Research Activities

  • Rush through surveys, provide low-effort responses, or engage in behavior intended to game incentives

  • Use automation, scripts, bots, or other tools to complete Research Activities

  • Use VPNs, proxies, location masking, or similar tools when used to misrepresent your location or eligibility or when prohibited by a Research Activity

  • Allow another person to participate on your behalf

  • Copy or paste answers from the internet or other sources when open-ended responses are requested

  • Attempt to obtain access to confidential study materials outside of authorized participation

  • Interfere with, disrupt, or compromise the Community’s systems or other participants’ ability to participate

Beta Hat may use quality control checks and fraud detection methods to protect research integrity.

 

5 - CONFIDENTIALITY AND NON-DISCLOSURE

Many Research Activities involve confidential information, including unreleased products, concepts, gameplay, monetization approaches, marketing materials, and other sensitive information (“Confidential Information”).

CONFIDENTIALITY APPLIES UPON REGISTRATION

By registering for the Community, you acknowledge and agree that confidentiality is a condition of membership, and that Confidential Information may be presented during Research Activities.

Your Confidentiality Obligations

You agree:

  • To keep all Confidential Information strictly confidential.

  • Not to disclose Confidential Information to any third party, including family or friends

  • Not to post or discuss Confidential Information on social media, forums, Discord, Reddit, or anywhere else

  • Not to reproduce, copy, distribute, or share study materials or Research Activity content

  • No Recording, Capture, or Sharing

Unless expressly permitted in writing, you may not record, screenshot, photograph, stream, or otherwise capture any part of a Research Activity, including playtests, videos, images, or concepts.

CONSEQUENCES OF BREACH

Any breach of confidentiality may result in immediate removal from the Community, forfeiture of incentives related to the breached activity, and potential legal action. Beta Hat and/or its clients may seek injunctive relief and other remedies.

 

6 - LIKENESS RELEASE AND PERMISSION TO USE CONTENT

In connection with the Community and Research Activities, you may provide or submit your name, username, voice, likeness, image, biographical information, statements, and other identifying information (collectively, your “Likeness”), as well as photos, videos, audio recordings, written responses, comments, quotes, testimonials, and other content you submit or that is collected in connection with your participation (collectively, “Content”).

By registering for the Community and participating in any Research Activity, you grant Beta Hat Industries, LLC and its affiliates, clients, service providers, and partners (collectively, the “Beta Hat Group”) a worldwide, royalty-free, fully paid-up, non- exclusive, perpetual, irrevocable, transferable, and sublicensable right to use, reproduce, publish, distribute, display, perform, edit, adapt, modify, create derivative works from, and otherwise use your Likeness and Content, in whole or in part, for any lawful purpose, including but not limited to research, analytics, internal business purposes, and marketing and promotional purposes (including testimonials), in any media now known or later developed.

You understand and agree that:

  • You will not receive additional compensation for these uses beyond any Incentive offered for the Research Activity, unless expressly agreed otherwise in writing

  • The Beta Hat Group may use your Likeness and Content with or without identifying you by name, and may edit or modify Content for length, clarity, or format so long as the meaning is not materially misrepresented

You waive any right to inspect or approve any use of your Likeness or Content

You release the Beta Hat Group from any claims arising out of the use of your Likeness or Content, including claims for defamation, invasion of privacy, right of publicity, or copyright infringement, to the fullest extent permitted by law

OPT-OUT OF PROMOTIONAL USE

If you do not want your Likeness or Content used for marketing or promotional purposes, you may contact us at support@betahatrc.com to request an opt-out. We will honor opt-out requests where feasible, but we may not be able to honor all requests depending on the nature of the Research Activity, prio use, or legal and business requirements.

7 - INCENTIVES AND COMPENSATION

Certain Research Activities may offer compensation (“Incentives”). Incentive details will be communicated in the invitation or at the start of the Research Activity.

You may not receive an Incentive if you do not complete the Research Activity, are screened out, or violate these Terms

 

TAXES AND 1099 REPORTING

You are responsible for any taxes related to incentives you receive. If required by law, Beta Hat may issue a Form 1099 to participants who earn $600 or more in incentives in a calendar year and may request information necessary for tax reporting.

8 - SWEEPSTAKES, PRIZE DRAWINGS, AND PROMOTIONS

From time to time, Beta Hat may offer sweepstakes, prize drawings, giveaways, contests, points programs, referral programs, or other promotions (collectively, “Promotions”) in connection with the Community.

Each Promotion may be subject to additional rules, eligibility requirements, prize descriptions, odds disclosures, and other terms (“Promotion Rules”), which will be provided at the time of entry or participation. In the event of a conflict between these Terms and any Promotion Rules, the Promotion Rules will govern for that Promotion.

Beta Hat may modify, suspend, or cancel any Promotion at any time as permitted by applicable law, including changing prizes, substituting prizes of equal or greater value, or adjusting eligibility requirements.

9 - PRIVACY AND DATA USE

Your participation may involve collection of personal information and research responses. Our use of data is described in our Privacy Policy, which is incorporated by reference into these Terms.

CLIENT SHARING

Beta Hat will not provide your full name, email address, or phone number to clients. Research findings are typically shared with clients in aggregated and/or de-identified form.

CHILDREN’S PRIVACY

The Community is not directed to children under 13 and we do not knowingly collect personal information from children under 13.

If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information as soon as reasonably practicable and terminate the associated account.

10 - INTELLECTUAL PROPERTY

All content, materials, designs, branding, survey instruments, and study materials provided through the Community are owned by Beta Hat or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from any Community materials without our express written permission.

11 - THIRD-PARTY SERVICES

We may use third-party vendors and platforms to run Research Activities, host communities, schedule sessions, or issue incentives (including Tremendous). Your use of these services may be subject to separate terms and privacy policies. Beta Hat is not responsible for third-party services beyond our control.​

 

12 - TERMINATION

You may close your account at any time by contacting us at support@betahatrc.com

Beta Hat may suspend or terminate your access at any time, with or without notice, including if we believe:

  • You violated these Terms

  • Your participation quality is consistently low

  • You engaged in fraud or confidentiality breaches

 

Upon termination, you may lose access to the Community and may forfeit unpaid incentives tied to violations.

13 -  DISCLAIMERS

The Community and all Research Activities are provided on an “AS IS” and “AS AVAILABLE” basis. We do not guarantee that:

  • You will qualify for any Research Activity

  • Research Activities will be available at any time

  • The Community will operate without interruptions or errors

14 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, Beta Hat will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your participation in the Community or any Research Activity, including loss of profits, loss of data, loss of goodwill, or business interruption, even if Beta Hat has been advised of the possibility of such damages.

To the fullest extent permitted by law, Beta Hat’s total liability for any claim arising out of or related to the Community, Research Activities, or these Terms will not exceed the total Incentives owed to you for completed Research Activities during the six (6) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15 - INDEMNIFICATION

You agree to indemnify and hold harmless Beta Hat, its affiliates, and its employees and representatives from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Community.

16 - CHANGES TO THESE TERMS

We may update these Terms from time to time. We will post updated Terms on the Community site and update the “Last Updated” date.

 

Your continued participation after changes take effect indicates acceptance of the updated Terms.

17 - ARBITRATION AND GOVERNING LAW (CALIFORNIA)

Please read this section carefully. It affects your legal rights.

Arbitration Agreement

Except for disputes where Beta Hat seeks injunctive or equitable relief (including confidentiality breaches), you and Beta Hat agree that any dispute arising out of or related to these Terms, the Community, or Research Activities will be resolved through final and binding arbitration, rather than in court.

NO CLASS ACTIONS

Arbitration will take place on an individual basis only. You and Beta Hat waive any right to bring disputes as a class, collective, representative, or mass action.

 

ARBITRATION VENUE AND RULES

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Arbitration will be administered by JAMS (or another mutually agreed arbitration provider) and will be conducted before one (1) arbitrator in San Francisco County, California. Hearings may be conducted by video conference at the arbitrator’s discretion. Judgment on the arbitration award may be entered in any court having jurisdiction.

This section does not prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction relating to confidentiality, intellectual property, unauthorized access to systems, or misuse of proprietary materials.
